नई दिल्ली। राज्यसभा चुनाव से जुड़े एक अहम मामले में सुप्रीम कोर्ट ने शुक्रवार को कांग्रेस नेत्री मीनाक्षी नटराजन की याचिका खारिज कर दी। शीर्ष अदालत ने स्पष्ट किया कि यदि किसी उम्मीदवार का नामांकन निर्वाचन अधिकारी द्वारा निरस्त कर दिया जाता है, तो उसके पास चुनाव आयोग का दरवाजा खटखटाने के अलावा कोई अन्य कानूनी विकल्प उपलब्ध नहीं होता।
सुनवाई के दौरान सुप्रीम कोर्ट की पीठ ने मीनाक्षी नटराजन से यह भी पूछा कि क्या वे ऐसा कोई पूर्व न्यायिक निर्णय प्रस्तुत कर सकती हैं, जिसमें अदालत ने इस प्रकार के नामांकन निरस्तीकरण के मामलों में सीधे हस्तक्षेप किया हो। इस सवाल का संतोषजनक जवाब न मिलने पर अदालत ने याचिका को खारिज कर दिया।
फैसले पर प्रतिक्रिया देते हुए मीनाक्षी नटराजन ने कहा कि यह निर्णय लोकतंत्र और संविधान दोनों के लिए एक बड़ा झटका है। उन्होंने इस पूरे घटनाक्रम पर गहरी चिंता जताई और कहा कि चुनावी प्रक्रिया में पारदर्शिता और निष्पक्षता सुनिश्चित होनी चाहिए।
गौरतलब है कि राज्यसभा चुनावों में नामांकन प्रक्रिया को लेकर अक्सर विवाद उठते रहे हैं। निर्वाचन अधिकारी के पास नामांकन पत्रों की जाँच करने और तकनीकी या कानूनी खामियों के आधार पर उन्हें अस्वीकार करने का अधिकार होता है। ऐसे मामलों में संबंधित उम्मीदवार को भारत निर्वाचन आयोग के समक्ष अपील करने का प्रावधान है।
सुप्रीम कोर्ट के इस फैसले से एक बार फिर यह स्पष्ट हो गया है कि चुनावी विवादों में न्यायपालिका सीधे हस्तक्षेप करने से परहेज करती है और संवैधानिक निकायों — विशेषकर चुनाव आयोग — को इस प्रक्रिया में प्राथमिकता दी जाती है। कांग्रेस पार्टी अब आगे की कानूनी और राजनीतिक रणनीति पर विचार कर सकती है।
New Delhi: The Supreme Court on Friday dismissed a petition filed by Congress leader Meenakshi Natarajan in connection with the Rajya Sabha elections. The apex court made it clear that once a candidate's nomination is rejected by the returning officer, the only available legal remedy is to approach the Election Commission of India — not the courts directly.
During the hearing, the Supreme Court bench also questioned Natarajan on whether she could cite any precedent where the court had intervened directly in such nomination rejection cases. Unable to provide a satisfactory answer, her appeal was dismissed.
Reacting to the verdict, Meenakshi Natarajan called the court's decision 'a blow to democracy and the Constitution,' expressing deep concern over the fairness and transparency of the electoral process.
The Supreme Court's ruling reinforces the established legal position that election-related disputes must first be addressed through the designated constitutional bodies, primarily the Election Commission, before approaching the judiciary. The decision underlines the court's consistent stance of non-interference in electoral procedures at the nomination stage.
The Congress party is now expected to deliberate on its next legal and political course of action in the matter.
